Independent valuations for 1991 Act tenancies

When a tenant farmer decides to relinquish or assign their tenancy, an independent valuation of the holding is required by law.

The Tenant Farming Commissioner has set up a panel of experienced, accredited valuers to make sure this process is fair, transparent and consistent for everyone involved.

What the Panel of Valuers is


The Panel of Independent Valuers was established by the Tenant Farming Commissioner (TFC) to support fair valuations under the Agricultural Holdings (Scotland) Act 1991.

Each valuer on the panel is:

  • Professionally qualified (for example, through RICS or SAAVA)
  • Experienced in agricultural valuation
  • Independent of both tenants and landlords

When a valuation is needed


You’ll need a valuation by a panel valuer if you are:

  • Relinquishing your tenancy: offering to give it up in return for compensation, or
  • Assigning your tenancy: transferring it to a new entrant or progressing farmer.

To take part, all parties need to agree to a few simple conditions:aThese rules apply to secure (1991 Act) agricultural tenancies, as set out in sections 73–79 of the Agricultural Holdings (Scotland) Act 1991.

The independent valuation helps ensure the process is fair to both tenant and landlord.

Find a valuer


You can contact any of the approved valuers directly. If the tenant and landlord agree on a preferred valuer, they can approach valuers to discuss availability, experience and fees.

Once both sides have agreed, the tenant should notify the TFC through their Notice of Intention to Relinquish, confirming the chosen valuer and the agreed fee.

If the tenant and landlord do not agree on a valuer, the TFC will request quotes from panel valuers using the information in the tenant’s notice, and will then appoint a valuer from the panel to carry out the work.

Joining the panel of valuers


The panel is reviewed from time to time. If you are a qualified valuer with experience in agricultural holdings, you may be able to apply in a future round.

Applicants must show:

  • Relevant professional accreditation
  • Practical experience in agricultural valuations
  • A sound understanding of agricultural holdings legislation
